Testing the Impact of Biased Jurors on the Efficiency of the Story Model of Jury Deliberation Process

چکیده
The story model of juror deliberation describes the deliberative process as a 3step cognitive process in which jurors attempt to assimilate and evaluate case-relevant information using pre-determined verdict decision rules. However, observational research has shown that not all juries engage in deliberations that resemble the deliberation style described by the story model. An important question is whether these two observed styles of deliberation, evidence driven and verdict driven, can be incorporated into the theoretical structure of the story model. A computer simulation is proposed that will allow researchers to develop some testable hypotheses regarding differences in jury deliberation styles.

The existing literature does not agree on the optimal jury size. We demonstrate that the probability of type I and type II errors is not sensitive to the number of jurors under the following three conditions: jurors receive independent signals about a defendant’s guilt during the evidence stage of the trial; the jurors truthfully reveal their signal before deliberations in the first ballot via ...

The concerns of jury research have extensively focused on subject selection, yet larger issues loom. We contend that the lack of information on deliberating jurors and/or juries is a much greater thr...
